Hello Nigel
Hope you can answer a question that our Development have been asking ourselves, part of the Development is supposedly a private road and is beginning to look like a patchwork quilt with the sites that have been dug up for water leaks etc. Our developer has said that we should put away some money to get the road tarmacked ourselves but we were wondering if the utility companies dig up the road surely they should be obliged to put down some suitable road covering

I think you're confusing ambition with ability. The road repairs usually take the form of filling the hole and just putting some concrete on top. It's hopeless!

I expect it's your local community that repairs water leaks - you could try asking them if they could resurface.

If it is a private road within the estate, which has not been adopted by the municipality, isn't it the responsibility of the estate committee to get it fixed?

Our development has two dead end private roads which are only used by owners served by the private roads. If these roads require some repairs are rest of the owners liable to pay a share?

If it's a private road the Management Committee are responsible for its maintenance and repair. But the utility companies/community should make good after they've made repairs.

The local authority are entitled to charge for the work they do repairing water pipes within the development - and I believe EAC and CyTA can also charge. Some local authorities do charge, others do not.
