Renting a property..

Hi. I am currently renting a property through an agent. For a 6 month contract which started in October 2018. I pay my rent in advance each month by direct debit. Yesterday we had 2 bailiffs and a representative from the bank of Cyprus come to repossess the property as the owner had not been paying the mortgage. After persuasion they left and said they would call us on Monday to discuss further. I informed my agent who said she was unaware of the situation regarding the owners non payment but was arranging for all the furniture to be removed on Monday. She can find us alternative accommodation for the remaining months but not until 14th January. Also at a higher rent. !! What are our rights?

Hi peeps

The first thing you must do is cancel the direct debit.

I don't understand how the agent can remove the furniture - I believe that will need a court order.

As for the bank, I'm not sure how you stand and I suggest you speak with a lawyer. IMO it will be in the bank's interest for you to remain in the property and pay the rent to them. It's likely that the bank will have it on their books for a long time before it sells and by allowing you to remain in it.

You could discuss this option with them tomorrow - and also the agent.

It seems to me from what you have said is that the owners have already instructed the agent to remove the furniture even though you have paid the rent for January and under normal circumstances would have no right in taking it, I would have thought the agent should be suspicious of this action, and in fact probably knows what is going on.
I would refuse entry to the agent from now on, easily said, but simply leaving the key in the locked door should stop them gaining entrance at least till you have spoken to the bank, who may want to take possession with the furniture.
Nigel's suggestion of renting from the bank is worth a chance.
