Hi
dont know if anyone can help me on this question.
Who is leagally responsible when apartment above verandah has comeaway and concrete coming off and it has affected apartment below verandah underneath.
it has been years of water drainging through.
unfortunately the owner from the above apartment ,is saying not her resposibility,and not going to pay.
Any advice would be appreciated

I would have thought it was the apartment above's responsibility.

I would get in touch with insurance company and let them sort it out.

Hi shoshanna

Assuming the balcony forms part of the apartment above and not part of the communal building it's the owner of that apartment's responsibility.

If it's part of the communal building (which I think unlikely) then the Management Committee should sort it out.

As both the Management Committee and the owner of the property above will have used the same insurance company there will not be any arguments as to which insurance company should repair.
