Hi Nigel, we are coming to Cyprus in a couple of weeks to start looking at properties.
We have seen a few on the internet that state the property has Land deeds as opposed to full deeds. Should we be wary of this?
Also a couple say that the Final certificate has been issued. Again should that be a cause for concern?

im so glad you have put this question forward as i have been wondering the same myself, have seen properties and they have the same info ref the deeds?

Having only the deed for the land means that the dwelling has yet to be added to it. You will need to check whether a Certificate of Approval has been issued and whether an applications been made to the Land Registry to have the dwelling added to the deed.

Even though the Certificate of Approval has been issued, you're not out of the woods. Surveyors from the Land Registry will visit to check that the dwelling has been correctly located on the plot - and the plot boundaries do not encroach on someone else's land.

The Land Registry will also check extensions to the property and any permanent structures that have been erected without planning consent.

If you can get the architectural drawings approved by the planning authority you can make a visual check to ensure there's nothing obviously 'wrong' with the dwelling.

But you cannot be 100% sure until the dwelling has been added to the deed.

That's slightly off-putting!

Should my lawyer be the one to find out all the necessary information if we went for a Land deed only property or would it just be a better bet to rule it out completely and look for full deeds only?

Hi Nick

Buying a property in Cyprus without a full Title Deed carries an element of risk. It all depends whether you're prepared to take that risk.

I suggest you instruct your lawyer to look in more detail at the 'Certificate of Completion' and also checks at the Land Registry whether an applications been submitted to add the dwelling to the deed. (If it has been submitted some indication of how long it will take.)

I assume that your lawyer has already checked the deed to ensure there are no issues?

We haven't got to that stage yet. We are still shortlisting suitable properties to view when we come out, but I'm thinking we may just forget about the ones without full deeds, just for our peace of mind.
