Will we ever get our Deeds

I live in one of 2. blocks built and occupied in 2007, The developer run out of money before the contract had finished leaving the street lighting and the final surface of the road to complete.
We were informed that these items would have to be completed before the deeds could be issued.
Last year the street lighting was paid by the two management companies after consulting the owners thinking that final work to the road may not have to be carried out.
Towards the end of last year it was suggested that we pay to have this work carried out only to find out that it would be way to expensive to do this.
I know that there are many complexes that have much more involved before receiving their deeds.
There are lifts never started and some that have not got planning permission to name a few.
What I would like to know is whether in this position the owners of these complexes will ever get their deeds?
With regards to the road. Who would be responsible for anyone getting injured due to the bad surface and would this mean that the road would ever be resurfaced?

Hi Roy

It sounds as if you got the information about the roads from a 'management company' - neither you nor I can say whether the information they've given you is accurate.

You need to visit the Town Planning Department and get information on what's needed from the horses mouth.

I can't comment on what the Town Planning Department may advise you, but I would have thought it might be possible to get your deeds if the Department issues a 'Certificate of Unauthorised Works. This will enable the Land Registry to to issue Title Deeds - but you would not be able to sell/mortgage the the property until the unauthorised works have been corrected.

I understand some people have got 'clean' deeds even though there are unauthorised works by paying the municipality a percentage of the cost of the work. But ideally all of you should contribute to the cost of any work that's necessary and then sue the developer to recover what you've spent.

And some municipalities are willing to do this work at cost price.
