we are 26 apartments and due to everybody not being present at any one time we have voted for a committee by e mail votes and have elected 2 members, is this legal and if so how do we register it at the land registery

Hi Pete

Yes it is legal and there is no requirement to register the committee at the Land Registry.

The committee should open a bank account and get a rubber stamp made bearing the name of the committee, which it will use ti stamp all it's documents. The bank may need the following information:

1. Document/paper from the Land Registry which confirms who the owners of the apartments are.

2. Minutes of the General Meeting of the owners of the apartments appointing the Management Committee.

3. Minutes of the Management Committee meeting concerning the opening of a bank account and appointment of individuals who are to manage the account.

4. In cases where the resident of a given apartment is someone other than the owner, a rental agreement.

5. ID, utility bill and proof of salary for those on the Management Committee.

I suggest that the committee visits the bank first and confirm what they need to open an account. (The above list was given to me by a banker with the Hellenic Bank.)

A committee in Paphos had some issues opening their account until the bank manager got a call from the Land Registry and a heated discussion took place.

I'm the secretary of an NGO here in Cyprus and every year our cheque signatories change. Our bank only needs details in item 5 if a cheque signatory does not have an account with the bank.

We have four cheque signatories - Chairman, Secretary, Treasurer + a committee member. All checques require two signatures.

(As there are only 2 members on your committee, one of them has to be the treasurer.)
