Hi nigel. In 2016 a vote was taken at our agm to start a fund for the painting of our complex however due to spiral costs the comittee had decided to employ a company to undertake the work even though we are 8,000euros short. They said the company doing the work will get the money from us after the work is completed. What i want to know is even though we voted for the contingency painting fund is it not iresponsible of the comittee to basically put us in debt to the tune of 8,000 euro. Several owners are unhappy as we dont know the terms of extra payments plus some are saying wait untill we can afford it. The committee are going to sign a contract with the company this week is this legal or can we stop it

Ask for an extra-ordinary General Meeting of the committee to discuss it.

If you copy everybody in then they cannot say they haven't seen your request and it makes everybody aware that there is a problem.

Plus of course where are they going to get 8,000 euros from.

They shouldn't take it from Communal funds without a vote.

And I don't think the company would go ahead on a promise.

Let me put it like this - if the Management Committee goes ahead with the paining and is unable to pay the company pursues them for payment, it is the Management Committee who will face the consequences.

I can't believe the MC will be stupid enough to order the painting work until they have the money to pay for it.

You need to call a general meeting of owners.

(BTW, it's good that the MC are building up a sinking fund to pay for external redecoration, etc.)

I'd be very surprised if any business would accept a job of this size without some up front payment. I certainly wouldn't. So the management committee is probably going to have to come up with 2000-3000 just for the company to start work.

Thanks for all your replies unfortunately i have since learned that the chairman is signing the contract today so no chance of calling a meeting
