A 78-year-old man has been arrested on suspicion of murder after a suspected burglar was stabbed to death.
The law doesn't require you to wait to be attacked before using defensive force, but does not protect you if, for example, your action is over-the-top or calculated revenge.
The CPS says if you have acted in reasonable self-defence, as described above, and the intruder dies you will still have acted lawfully.
I think you have to be a bit careful with such incidents. At least until the smoke clears and all the facts emerge.
It’s been a long time and I haven’t looked it up; however, there was another case of a homeowner in the UK killing a burglar, who’d gotten into his home. I believe that when the full story emerged he’d shot a 16 year old kid in the back, whilst he was trying to escape through a window, killing him.
The initial media-fest was along the lines of “Heroic vigilante.........” and there was a similar outcry at his being arrested.

The man, named locally as Richard Osborn-Brooks, discovered two intruders in South Park Crescent, Hither Green, south-east London, on Wednesday.
