I hope someone can answer my question. My friend, who is English, recently passed away leaving his house here in Cyprus to his daughters who reside in England and are uk born. They have been told as they do not live in Cyprus that they can not act as executors. Is this true. There solicitor has told them that she can only be the sole executor, she lives in Cyprus. Many thanks.

Did your friend make a Will in Cyprus or the UK naming his daughters as the executors of his estate?

If he didn't name an executor, I think the court has to appoint one. (But I'm not absolutely sure).

It is not true to say that an executor has to be based in Cyprus.

However the process is slow, bureaucratic and entirely in Greek. So it is probably pragmatic for an executor not in Cyprus to appoint someone who is based in Cyprus to act on their behalf.
