we are a block of 11 apartments. One of the apartments has been rented out for 3 years now, to the same family. for the last 2 years they have paid the communal fees. This year the family have said the owner should pay the fees. Can you tell me, by law who is responsible for paying the fee. And should the landlord and tenant sort this or management and landlord or management and tenant. Sorry if you have been asked this before. Thank You
From the advice our committee was given is that the owner is responsible for maintenance payments. It is up to the owner and his tenant to sort out who should pay it to the committee when their tenancy agreement was signed -but the owner is the one who would be taken to court for non payment if it came to it.
As billibob has advised it is the owner of the property who is responsible for paying the management fees. And even though the owner may have made those renting the property responsible for paying in the rental agreement, it is ultimately the responsibility of the owner to pay.
